1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the OnlineProgram.Africa mobile application ("App," "Service," "we," "us," or "our"). By accessing or using the App, you agree to comply with and be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not use the App and should uninstall it immediately.

2. Description of Service

OnlineProgram.Africa provides a mobile drag-and-drop content management system (CMS) that allows users to:

• Create and design online event programs, invitations, and digital content
• Use templates and customization tools to personalize designs
• Store created content locally on their device
• Export and share their created programs
• Manage their content through an intuitive drag-and-drop interface

3. Account Registration and Login

3.1 Account Creation

To access certain features of the App, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Not share your login credentials with others
• Use a strong, unique password
• Log out from shared devices

4. User Content and Data Storage

4.1 Local Storage

All content you create using the App (including but not limited to event programs, designs, images, and text) is stored locally on your device. We do not automatically backup or sync your content to cloud servers.

4.2 Your Responsibility

You are solely responsible for:

• Backing up your content if desired
• Maintaining sufficient device storage space
• Understanding that uninstalling the App will delete all locally stored content
• Manually exporting content if you wish to transfer it to another device

4.3 Content Ownership

You retain all ownership rights to the content you create using the App. By using the App, you grant us a limited, non-exclusive license to host, store, and display your content solely for the purpose of providing the Service to you.

4.4 Content Guidelines

You agree not to create, upload, or share content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains malicious code, viruses, or harmful components
• Is offensive, defamatory, obscene, or inappropriate
• Impersonates any person or entity
• Contains false or misleading information
• Promotes illegal activities or violence

5. Intellectual Property Rights

5.1 Our Intellectual Property

The App, including its design, features, functionality, templates, graphics, and underlying code, is owned by OnlineProgram.Africa and is protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App's code or design
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Create derivative works based on the App
• Use our trademarks without written permission

5.2 User-Generated Content

While you retain ownership of your created content, you must ensure that any images, fonts, or third-party materials you use in your designs do not infringe on others' intellectual property rights.

5.3 Templates and Assets

Templates, graphics, and design assets provided within the App are licensed for your personal and commercial use within the App only. You may not extract, redistribute, or resell these assets separately from the App.

6. Prohibited Uses

You agree not to use the App for any of the following purposes:

• Any unlawful purpose or in violation of these Terms
• To transmit spam, chain letters, or unsolicited communications
• To impersonate or attempt to impersonate OnlineProgram.Africa or other users
• To interfere with or disrupt the App's functionality or servers
• To attempt to gain unauthorized access to the App or related systems
• To collect user information without consent
• To use automated systems (bots, scrapers) to access the App
• To upload malicious code, viruses, or harmful content
• To create competing products or services
• To harass, abuse, or harm other users

7. Subscription and Payment Terms

7.1 Free Features

Certain features of the App may be available for free. We reserve the right to modify, limit, or discontinue free features at any time.

7.2 Premium Features

Premium features may be available through in-app purchases or subscriptions. By purchasing premium features, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate payment information
• Accept that all sales are final unless otherwise specified
• Understand that subscriptions auto-renew unless cancelled

7.3 Refunds

Refund policies are governed by the Google Play Store's refund policy. Please refer to Google Play's terms for information about refunds.

7.4 Price Changes

We reserve the right to modify pricing for premium features at any time. Price changes will not affect existing active subscriptions until renewal.

8. Service Availability and Modifications

8.1 Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The App will be available at all times without interruption
• The App will be error-free or bug-free
• Defects will be corrected immediately
• The App will meet all your specific requirements

8.2 Maintenance and Updates

We may perform maintenance, updates, or modifications to the App at any time, which may result in temporary service interruptions. We will attempt to provide notice when possible.

8.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any feature or the entire App at any time without prior notice or liability.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Provision

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty

We do not warrant that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• Your device or data will not be damaged by using the App

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONLINEPROGRAM.AFRICA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your content
• Loss of data stored on your device

9.4 Maximum Liability

In jurisdictions where limitation of liability is not permitted, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless OnlineProgram.Africa and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App
• Your content or any content you submit, post, or transmit through the App
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may stop using the App at any time by uninstalling it from your device and, if desired, deleting your account.

11.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at any time, without notice, for any reason, including if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your actions harm other users or the App
• We discontinue the service

11.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• You must uninstall the App from your device
• We may delete your account information from our servers
• Local data on your device will remain until you uninstall the App
• Provisions that by their nature should survive will remain in effect

12. Data Backup and Loss

Since all content is stored locally on your device, you acknowledge and agree that:

• We are not responsible for backing up your content
• You are solely responsible for creating backups of important content
• We are not liable for any data loss resulting from device issues, App uninstallation, device upgrades, or any other cause
• We recommend regularly exporting your content for safekeeping
• Lost data cannot be recovered by us due to the local storage nature of the App

13. Third-Party Services and Links

The App may contain links to third-party websites, services, or resources. We are not responsible for:

• The availability, content, or practices of third-party services
• Any damage or loss caused by third-party services
• The privacy policies or terms of third-party services

Your use of third-party services is at your own risk and subject to their terms and conditions.

14. Geographic Restrictions

The App is controlled and operated from our facilities in Africa. We make no representation that the App is appropriate or available for use in other locations. If you access the App from outside Africa, you do so at your own risk and are responsible for compliance with local laws.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where OnlineProgram.Africa is registered, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

1. Informal Negotiation: Contact us first to attempt resolution
2. Mediation: If negotiation fails, both parties agree to attempt mediation
3. Arbitration or Court: If mediation fails, disputes may be resolved through binding arbitration or in appropriate courts

15.3 Class Action Waiver

To the extent permitted by law, any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify users through the App or via email for material changes
• Provide a reasonable notice period before changes take effect

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OnlineProgram.Africa regarding the use of the App and supersede all prior agreements and understandings.

19. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms at any time without restriction.

21. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

23. Acknowledgment

BY USING THE ONLINEPROGRAM.AFRICA APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
